At Emprez Inc. (“we”), we respect your privacy and are committed to maintaining your trust. This Privacy Policy describes your privacy rights regarding the collection, use, storage, sharing and protection of your personal information by Emprez Inc. for the Emprez – Schedule Management application (the “Application”, or “Emprez”). By using Emprez, you agree to the terms of this Privacy Policy and expressly consent to the processing of your personal information as described in this Policy.

In this policy, the term personal information means information that relates to an identifiable individual.

  1. Basis of information processing

In order to allow you to use the Application and its features, we may need to collect and process personal information about you. The processing of personal information by Emprez Inc. is essentially based on the following principles:

We need to process certain personal information in order to be able to provide you with access to the Application. To this end, we also aim to act as a tool to facilitate the working relationship between you and your employer. At no time can the Application be interpreted as acting as an employment contract.

We process your personal information on the basis of your consent expressed when you accept our terms of use.

We may process certain personal information because you have specifically consented to the processing. You can always withdraw your consent and we will then stop processing your personal information based on your consent. However you may not be able to use the Application if we cannot process your personal information.

  1. Information Collected 

We may collect information about you when you use Emprez, for example:

  • When you or your employer create an account in Emprez, we may ask for personal information such as your first and last name, email address, phone number, profile picture and other information that you may provide when creating your account. account. You can, at any time, modify this information in your account via the “Settings” tab of the Application.
  • We may retain information that your mobile device provides to us during your use of Emprez, such as mobile device type, unique identifier, IP address, operating system, and physical location (geolocation). You can opt out of the use of certain location data on your device, for example by turning off Emprez Location Services in the privacy settings of iOS and Android. We may also retain Usage Data such as the date and time the application on your device accesses our servers.
  • We collect information relating to your shifts, date, time and place of work, the positions you hold, your hourly wage as well as your arrival and departure times at work (the Application may act as a time and location stamp for your employers if they wish).
  • If the time stamp function on the application is used, a geolocation function is activated to ensure that the person is indeed at the workplace or any other place determined by the employer. Once the punch function has been used, the geolocation switches off automatically. 
  1. Use of personal information

We may use your personal information:

To offer the services provided by Emprez.

To send you administrative information, for example, information regarding our services and changes to our terms, conditions and policies.

To send push notifications to your mobile device. If you previously agreed to receive push notifications and no longer wish to receive them, you can disable push notifications at the device level.

To send email notifications to the email address provided to us. If you no longer wish to receive them, you must contact the application manager to inform them to disable email notifications.

For our business purposes, such as data analysis, audits, fraud monitoring and prevention, developing new products and services, improving or modifying our products and services, and identifying trends of use.

For requests such as: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) allow us to pursue available remedies or limit the damages that we may sustain.

We may use data collected through the Application to monitor users’ use of the Application generally, to prevent misuse of the Application, to identify problems or bugs in the Application and to determine features for improvement.

  1. Storage of personal information

We keep the personal information collected until you ask us to destroy it or our activities no longer require us to keep it. However, we do not undertake to keep the personal information collected for a specific period. The personal information collected is stored electronically, on servers operated by our service providers. Emprez servers are located in Canada.

  1. Security of your information

The security of personal information is a priority for Emprez. We maintain our service and all associated data with technical, administrative, and physical safeguards to protect against the loss, unauthorized access, destruction, misuse, alteration, and improper disclosure of your information. Unfortunately, no data transmission or storage system can be guaranteed to be 100% guaranteed.

Your personal information is hosted by our service providers who undertake to us to use reasonable security measures in order to preserve the integrity and confidentiality of the information. Our employees and suppliers are informed of the confidential nature of the personal information collected and are made aware of the appropriate security measures to prevent unauthorized access to personal information. We will not sell or share your personal information with third parties except as described in this policy. Your personal information could be communicated to the categories of persons described below for the purposes which are mentioned: 

Employees of Emprez

The personal information collected is only accessible to our officers and employees who must access it to make the use envisaged by this policy.

Service providers

We share certain personal information with service providers that enable us to serve our customers more effectively. We do not sell your personal information and we do not allow our suppliers to use this data on an individual basis. Our suppliers agree in writing to us to maintain the confidentiality of the information and not to use it other than to provide us with services.

Your employer

We may share certain personal information with your employer when using the Application. Indeed, all the information you put in your personal file on the Application is visible to your employer. However, your employer undertakes to limit their use to the contractual working relationship he has with you.

Legal obligations

We may communicate the personal information collected to third parties if the law expressly authorizes or requires it, or if we are forced to do so by a competent authority. We may disclose personal information in legal proceedings if necessary to protect our rights or those of our users.

Business transfer

In the event that the sale, or the restructuring of all or part of our business is contemplated, we may transmit the personal information collected to the persons or organizations involved before and after the transaction, whether or not it is carried out. If you wish to review, correct, update, modify or delete the personal information you have previously provided, you may contact us by logging into your account and making the appropriate changes or by emailing info@emprez.net . Please indicate which personal information you wish to modify or delete from our database. For your protection, we can only modify requests with respect to the personal information associated with the email address you use to send us your request, and we may need to verify your identity before implementing your request. We will try to respond to your request as soon as possible. In the event that you wish us to delete the personal information that we hold about you through the Application, we will notify your employer who will benefit from a period of ten (10) days to register the said information which is necessary to hold a complete and compliant employee file. Please note that we may need to retain certain information for record-keeping purposes. There may also be residual information that will remain in our databases and other records, which will not be deleted.

  1. Your choices regarding our use and disclosure of personal information

The information you provide may be used by Emprez for marketing purposes, including but not limited to one-time promotional emails. We offer you many choices regarding our use and disclosure of your personal information for marketing purposes. You can unsubscribe from our electronic communications: If you no longer wish to receive emails from us, you may opt-out of receiving such emails by sending a list removal request to info@emprez.net. By registering with your personal information in Emprez, you can unsubscribe from our electronic mailing lists at any time; if you request it, we will not use your details for marketing purposes.

We will try to respond to your requests as soon as possible. Please also note that if you opt out of receiving emails from us, we may nevertheless send you messages for administrative or other purposes directly related to your use of Emprez, and you cannot opt ​​out of receiving such messages, unless you stop using the Application.

Subject to applicable legislative exceptions, Emprez is controlled and operated by a Canadian corporation and will not submit to the laws or jurisdiction of any state, country or territory other than that of Canada.

We ask that you do not send us, and do not disclose, any sensitive personal information (for example, social security number, racial or ethnicity information, political opinions, religion or other beliefs, health, biometrics or union membership or criminal history) through Emprez, except where explicitly requested.

  1. Changes to this Privacy Policy 

We reserve the right to modify this privacy policy. Please check the “Last Updated” notice at the top of this page to see the most recent revision date of this Privacy Policy. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Application and you accept the changes through the notification related to this new version appearing on your screen upon your next login. Your use of Emprez following these changes means that you accept the revised Privacy Policy.

For any question related to your personal file on the Application and on subjects relating to your contractual employment relationship with your employer, for example, your name, address, telephone number, availability and shifts, we invite you to communicate directly with your employer. For any question related to a technical problem of the Application regarding your access or the use of its functionalities, we invite you to contact us via the following address: support@emprez.net.

This privacy policy and all related transactions will be governed by the laws of the province of Quebec and the laws of Canada applicable therein and must be interpreted in accordance with these laws.
